CONDITIONS FOR ACCESS
As an employee of the TRACTEBEL Group, you have a general right to access the Platform and a specific right to access the Training Modules assigned to you initially and/or over time.
Your access rights may be limited in time, for example, when you have been given a specified period within which to complete a particular training course. It is your responsibility to complete the training courses within that time frame.
These access rights are strictly personal. Consequently, you may not provide access to the Platform or your Training Modules to any third parties, including other TRACTEBEL Group employees. You also agree not to provide any third party with the means of authentication (login/password) assigned to you to access the Platform and/or the Training Modules.
TECHNICAL ENVIRONMENT AND SECURITY
You can access the Platform at any time from your workstation. For technical reasons, we recommend that you connect to the Platform by cable connection only, and not via Wi-Fi.
You are prohibited from accessing or attempting to access the Platform from any other computer workstation within the TRACTEBEL Group or from any computer workstation outside the TRACTEBEL Group, unless expressly authorized and in all cases, only under the conditions set forth in the applicable rules on computer security and/or remote working.
Logins and passwords can be provided to you for Platform access (the "Credentials").
Credentials are strictly personal, confidential and exclusively for internal use. Therefore, you agree not to provide credentials to any third parties to allow them to connect to the Platform.
You agree to take the necessary security precautions to prevent the disclosure of your Credentials to third parties. You are hereby informed that the use of your Credentials by a third party may alter your follow-up and evaluation information
In using the Platform, you agree to comply with the IT security policy applicable within the TRACTEBEL Group, as well as any applicable charter covering the use of IT tools
You agree to make fair use of the Platform and the Training Modules and not to use the Platform and the Training Modules for purposes other than those related to your occupational training needs and/or the performance of your duties within the TRACTEBEL Group.
In particular, you agree to follow the training courses without outside help and without seeking to mislead the methods of monitoring your results or to distort the operation of the software. You agree not to post answers to problems that are being used to assess employee performance.
You agree not to circumvent any technical security measures that may be incorporated into the Platform, and more generally not to make any use of the Platform or the Training Modules that could be considered fraudulent or contrary to applicable laws and regulations.
Some training courses are mandatory. You agree to follow the training courses within the allotted time limit and to remain attentive to what courses are open to you.
You must make responsible use of the information, content and data made available to you on the Platform and in the Training Modules.
In this respect, TRACTEBEL shall ensure that the information within the Platform and Training Modules is as accurate as possible.
However, this information may be provided by third parties, be subject to interpretation, or become obsolete over time, for example in the event of changing legal frameworks, standards or professional practices.
Therefore, please bear in mind that the information provided through the Platform or the Training Modules is made available solely for information purposes: it cannot be considered as advice that is applicable in principle to a particular situation or as a recommendation that can serve as the standalone basis for a decision, without having been verified for accuracy.
You acknowledge that TRACTEBEL cannot be held liable for any damage whatsoever attributable to the incompleteness or inaccuracy of the information, content or data available on the Platform or in the Training Modules.
COMPLIANCE WITH INTELLECTUAL PROPERTY RIGHTS
The content of the Platform and/or the Training Modules may be protected by intellectual property rights belonging to TRACTEBEL or third parties.
Consequently, you shall refrain from downloading, extracting, reproducing, copying, duplicating or communicating the contents of the Platform or the Training Modules to third parties or the public and generally speaking, from using these contents for purposes other than those related to your occupational training needs or your duties.
The Platform and/or certain Training Modules may include confidential information about the TRACTEBEL Group, TRACTEBEL or third parties.
In this regard, you are reminded that as a TRACTEBEL Group employee, you are subject to professional secrecy rules and that you are bound by a duty of confidentiality throughout your use of the Platform.
You must therefore ensure that you use the Platform in accordance with your obligations in this regard and refrain from disclosing any information derived from the Platform. All information appearing on the Platform and in the Training Modules is considered confidential.
Your use of the Platform may be subject to the processing of personal data in accordance with the French Data Protection law of 6 January 1978 (as amended by law n° 2018-493 of 20 June 2018) and Regulation (EU) 2016/679 dated 27 April 2016, to enable TRACTEBEL, in its capacity as data controller, and WeUp Learning, as processor, to provide you with Platform access, to monitor your training for the purposes of your professional evaluation, or as part of certain legal obligations borne by TRACTEBEL.
In particular, your connections, your route on the Platform and the results of tests integrated in the Modules may be recorded and analyzed.
This information is only accessible to persons who need to know it for the purposes described above.
It is kept throughout the duration of your Employment Contract and for a maximum of 5 years thereafter.
With respect to your personal data, you have the right to access, the right to rectification, the right to erasure, the right to restrict, the right to object, the right to restriction of processing, the right to data portability, which you can exercise by sending an e-mail to the following address:
Pursuant to the applicable regulations, you have the right to lodge a complaint with the competent control authority (as the CNIL in France).
